1. Acceptance of Terms: Use of this website and services offered by Poster Memorabilia (“Website”) is subject to these terms of service (“Terms”). By accessing or using this Website, you agree to be bound by these Terms. If you do not agree to these Terms, do not use this Website.

2. Changes to Terms: Poster Memorabilia reserves the right to modify these Terms at any time without prior notice. Your continued use of the Website following any changes to these Terms constitutes your acceptance of the modified Terms.

3. Product Information: Poster Memorabilia endeavors to be as accurate as possible in the description of its products and services, however, Poster Memorabilia does not guarantee that product descriptions, pricing or any other content available on this Website is error-free, complete, reliable, current, or free of other errors.

4. Poster Memorabilia Price Adjustment Policy: At Poster Memorabilia, we understand the importance of providing our customers with the best value, especially during our promotional sales. To support this commitment, we offer a price adjustment policy for purchases made shortly before a sale. Customers who purchase a poster from us within 7 days before the start of a promotional sale may be eligible for a price adjustment. This adjustment is applicable when the purchased poster is exactly the same as the one on sale, including its design, size, and edition. However, please note that clearance items, final sale products, and certain special promotions may be excluded from this policy.

   To request a price adjustment, customers should contact our customer service team via email at support@postermemorabilia.com within 7 days of the sale's commencement. A valid receipt or order number will be required to process the request. Upon verification, the price difference will be refunded to the original payment method used for the purchase.

   We reserve the right to modify or cancel this price adjustment policy at any time. This policy is also subject to all applicable laws and regulations. 5. Order Processing: All orders are subject to acceptance and availability. Poster Memorabilia reserves the right to refuse an order for any reason, including but not limited to: product unavailability, inaccuracies, or errors in product or pricing information.

6. Payment: Poster Memorabilia accepts payment through major credit cards and PayPal. Payment must be received by Poster Memorabilia prior to shipment of any product or service.

7. Shipping: Shipping times are estimates only and Poster Memorabilia is not responsible for any delays in shipping or delivery. Title and risk of loss for all products ordered by you shall pass to you on Poster Memorabilia's delivery of the products to the carrier.

8. Return and Refund Policy: Poster Memorabilia accepts returns within 90 days of receipt of the product for a full refund, provided the product is in its original condition and packaging. If a product is damaged during shipment, Poster Memorabilia will either replace the product or issue a refund at its discretion. Returns will be paid for and organized by the returnee. 9. User Conduct: You agree not to use this Website for any unlawful purpose, or for the promotion of illegal activities. You agree not to interfere with or disrupt this Website or servers or networks connected to this Website, or to disobey any requirements, procedures, policies or regulations of networks connected to this Website.

Proprietary Rights: All content on this Website, including text, images, graphics, logos, icons, software and other materials, is the property of Poster Memorabilia or its licensors and is protected by United States and international copyright and trademark laws. Any unauthorized use may violate copyright, trademark, and other laws.

11. Disclaimer of Warranties: Poster Memorabilia makes no representations or warranties of any kind, express or implied, as to the operation of this Website or the information, content, materials, or products included on this Website. To the full extent permissible by applicable law, Poster Memorabilia disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.

12. Limitation of Liability: Poster Memorabilia shall not be liable for any damages of any kind arising from the use of this Website or the products purchased herein, including but not limited to direct, indirect, incidental, punitive, and consequential damages. If the purchased item does not meet your expectations within this period, you may return it in accordance with our Return Policy. Once the 90-day return period has expired, Poster Memorabilia assumes no responsibility for any perceived or actual damages or dissatisfaction with the product. 

13. Indemnification: You agree to indemnify, defend and hold harmless Poster Memorabilia, its officers, directors, employees, agents, licensors, suppliers and any third-party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Website using your account.

14. Governing Law: These Terms shall be governed and construed in accordance with the laws of the country of the client, without giving effect to any principles of conflicts of law. Any legal action arising out of these Terms or your use of the Website shall be brought exclusively in the courts of Geneva.

15. Dispute Resolution: Any dispute arising out of or related to these Terms or the Website shall be resolved through binding arbitration in accordance with the Geneva Rules of Arbitration.

1. 14. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

   15. Entire Agreement: These Terms constitute the entire agreement between you and Poster Memorabilia and supersedes all prior agreements, understandings and negotiations, whether written or oral, between the parties with respect to the subject matter of these Terms.

   16. No Waiver: The failure of Poster Memorabilia to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

   17. Zero Abuse Policy: At Poster Memorabilia, we are committed to providing a safe and respectful work environment for all our staff. We have zero tolerance for any form of abusive behavior directed towards our employees.

       1. Abusive behavior includes but is not limited to:

          • Threats, harassment, or intimidation towards our staff
          • Discrimination based on race, gender, sexual orientation, religion, or any other characteristic protected by law
          • Verbal or physical abuse towards our staff
          • Spamming, trolling, or any other form of disruptive behavior on our website or social media platforms

          If any user engages in such behavior towards our staff, we reserve the right to take action, including but not limited to:

          • Blocking the user from accessing our website or social media platforms
          • Reporting the user to the relevant authorities or law enforcement agencies
          • Pursuing legal action against the user

          We take all such incidents seriously and will do everything in our power to protect our staff from abusive behavior. By using our website or social media platforms, you agree to comply with this policy and understand the consequences of violating it.

   18. SMS/MMS Mobile Message Marketing Program Terms and Conditions: Poster Memorabilia (hereinafter, “We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), which you agree to use and participate in, subject to these Mobile Messaging Terms and Conditions (the “Agreement”). We may modify or cancel the Program or any of its features without notice. This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts. We may also modify this Agreement at any time and your continued use of the Program following the effective date of any such changes shall constitute your acceptance of such changes.
   19. The Program allows Users to receive SMS/MMS mobile messages by opting into the Program, such as through online or application-based subscription forms. Your consent to receive automated marketing text messages is not required as a condition of purchasing any goods or services. Regardless of the opt-in method you used to join the Program, you agree that this Agreement applies to your participation in the Program. If you have opted in, the Program provides updates, alerts, information, promotions, specials, and other marketing offers (e.g., product discounts) from Poster Memorabilia via text messages through your wireless provider to the mobile number you provided. SMS/MMS mobile messages may be sent using an automated telephone dialing system or other technology. Message frequency varies. You are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.
   20. If you do not wish to continue participating in the Program or no longer agree to this Agreement, you agree to reply STOP to any mobile message from Us in order to opt-out of the Program. You may receive an additional mobile message confirming your decision to opt-out. You understand and agree that the preceding options are the only reasonable methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out. If you wish to opt-out please follow the procedures above.We may change any telephone number we use to operate the Program at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages. The wireless carriers supported by the Program are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages, including, without limitation, notifying us immediately if you change your mobile number. You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from your use of the Program or from you providing us with a phone number that is not your own. If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the Opt-Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a required part of these terms and conditions. You further agree that, if you change your telephone number without notifying Us of such change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by Us, or any party that assists in the delivery of the SMS/MMS mobile messages, as a result of claims brought by individual(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of our Programs. You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Program, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. You may not use or engage with the Platform if you are under thirteen (13) years of age. If you use or engage with the Platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent’s or legal guardian’s permission to do so. By using or engaging with the Platform, you acknowledge and agree that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18), and have your parent’s or legal guardian’s permission to use or engage with the Platform, or are of adult age in your jurisdiction. By using or engaging with the Platform, you also acknowledge and agree that you are permitted by your jurisdiction’s Applicable Law to use and/or engage with the Platform.
   21. All communications regarding orders, inquiries, and customer service at PosterMemorabilia must be conducted exclusively via email. This ensures a timely and documented response to all matters.
